Terms & Conditions

These Terms & Conditions govern your use of magneticscreens.ch and any purchase you make from Magnetic Screens (a division of Caruso Consulting Co Ltd, "we", "us" or "our"). By using our website or placing an order, you agree to these terms. Please read them carefully. Our full provider details are on the Imprint page.

How a contract is formed

The products shown on this site are an invitation to you to place an order, not a binding offer. Your order is the offer. A contract comes into being when we accept it, which we do by sending you an order confirmation email or by dispatching the goods, whichever happens first. Our pre-contract information duties follow UWG Art. 3(1)(s), which requires an online supplier to identify itself clearly and to state the essential terms before you order.

Prices and payment

All prices are in euro and include Swiss VAT at the applicable rate. Delivery is charged separately and shown before you pay: CHF 22 flat, or free on orders of CHF 50 and over. Payment is taken at checkout by card through Stripe or through PayPal. We do not store your full card details.

Where a product shows a previous price alongside the current one, the previous price is the price this shop charged for that item before the current offer. If a price is obviously wrong, for example through a typing error, we will tell you before dispatch and you can confirm the corrected price or cancel at no cost.

Cutting a screen to size

Every standard screen is designed to be cut down at home to fit your own opening. Order the size above your measurement. Once you have cut a screen it cannot be returned as unwanted, though your rights over faulty goods are unaffected. Screens we make to your measurements are covered separately on the Refunds & Returns page.

Your right of withdrawal

We give you 14 days to change your mind. This is our own policy, not a statutory right: Switzerland has no cooling-off period for online orders, because the revocation right in Art. 40a-40f OR covers doorstep and telephone sales only. Faults and guarantees

The statutory warranty for defects under Art. 197 to 210 OR gives you two years from delivery (Art. 210(1) OR), and it cannot be shortened on a consumer sale (Art. 210(4) OR). Nothing in these terms limits that, or any other right you have as a consumer that cannot be excluded by agreement.

Acceptable use

Please do not misuse the site: no attempting to break into it, no scraping it for a competing catalogue, and no using it for anything unlawful. We may withdraw access if you do.

Our liability

Our liability is set out on the Limited Liability Indemnity page. Nothing there or here excludes liability for injury to life, body or health, for intent or gross negligence, or under the Swiss Product Liability Act (Produktehaftpflichtgesetz, PrHG).

Changes to these terms

We may update these terms. The version that applies to your order is the one published when you placed it.

Governing law and disputes

These Terms are governed by Swiss law, without prejudice to any mandatory consumer protections of the country you live in that would otherwise apply to you. Your statutory rights as a consumer remain unaffected. We are not obliged to take part in proceedings before a consumer arbitration board and do not currently do so, but we would much rather settle any dispute with you directly, so please contact us first.
